Minutes of the Meeting of the Plans Scrutiny Committee held on Tuesday 26 June 2007 in the Civic Chamber, Council Offices, Skelmanthorpe

97 Declarations of Councillors’ Interests A personal and prejudicial interest was declared by Cllr A Heaton in Item 9, Application No. 2007/62/92281/E3 and a personal interest was declared by Cllr A Tribe in Item 9, Application No. 2007/60/91982/E3.
98 Suspension of Standing Orders It was RESOLVED that standing orders be suspending in accordance with standing order No. 79 to enable members of the public to address the meeting.
99 Public Discussion Time A member of the public addressed the meeting in regard to Planning Application No. 2007/60/91982/E3.
100 Return to Standing Orders It was RESOLVED to return to standing orders.
101 Apologies for Absence Reasons for absence from the meeting were submitted by Cllrs K Thursby and D Kaye. It was RESOLVED that the reasons for absence submitted by the above councillors be accepted as valid.
102 Minutes It was RESOLVED that the minutes of the meeting held on 22 May 2007 which had been approved by the full council meeting on 5 June 2007 be noted.
103 Business Arising The Clerk submitted a letter Kirklees MC concerning the objections lodged by Mr Fosbrook to Application No. 2007/62/91269/E3, erection of extension to farm shop at Thorncliffe Farm Shop, Emley Moor. The Committee was concerned to note that the planning enforcement officer acknowledged that the Thorncliffe Farm Shop had breached planning conditions but that he maintained that it was not in the public interest to immediately enforce without exploring alternative solutions because of the potential incursion of costs at appeal. It was RESOLVED that the Parish Council write to the planning enforcement officer protesting at this course of action and seeking an assurance that in the interests of consistency, justice and to ensure public confidence in the planning process, breaches of planning conditions be enforced, irrespective of any costs involved.
104 Planning Notifications Planning notifications were considered and observations made thereon. Cllr Heaton absented herself from the meeting while application No. 2007/62/92281/E3 was discussed. It was RESOLVED that Application No. 2007/60/91982/E3, outline application for temporary permission for the erection of a warden’s cottage at Birdsedge Countryside Project be deferred to the next council meeting with a recommendation to object due to the fact that the application conflicts with green belt policy.
105 Planning Decisions The Clerk submitted a list of planning decisions. These decisions were considered and it was RESOLVED the parish council seek further information about the grounds for refusal of Application No. 2007/62/90485/E3 (H Lodge & Sons. Certificate of Lawfulness for an existing mixed use as a wholesale (with ancillary retail) horticultural nursery garden and for storage in connection with groundworks/landscape contracting) and Application No. 2007/62/91351/E3 (erection of a two storey and a single storey extension at 14 New Lane, Skelmanthorpe). It was RESOLVED that the remaining decisions be noted.
106 Matters Relevant to the Denby Dale Parish Area The Clerk submitted highway reports, the Kirklees MC Economic Bulletin and the Open Spaces Society newsletter. It was RESOLVED that these documents be noted. The Clerk also submitted information about a free information event being held on Saturday 14 July 2007 by the Department for Communities and Local Government on the Planning White Paper in Selby. It was RESOLVED that those committee members who wished to attend should contact the Clerk by the following week.
