1000 Public Session No members of the public raised any matters.
1001 Apologies for Absence Reasons for absence were received from Cllr S Simpson. It was RESOLVED that the reasons for absence submitted be accepted as valid.
1002 Declarations of Councillors’ Interests There were no declarations of interest.
1003 Admission of the Public It was RESOLVED that there were no items requiring the exclusion of the press and public.
1004 Minutes It was RESOLVED that the minutes of the meeting held on 27 January 2009 be received.
1005 Appeal by Hawley Investments Ltd against Refusal of Planning Applications The Clerk submitted correspondence from Kirklees Council advising of the appeal lodged by Hawley Investments against the refusals by the council of Application Nos. 2008/70/92182 and 2008/70/92165. It was RESOLVED that a letter supporting Kirklees Councils refusal be sent to the Planning Inspectorate.
1006 Planning Application No. 2008/62/93577 Rear of 17 Huddersfield Road, Skelmanthorpe The Clerk submitted correspondence from Kirklees Council explaining that the second application had been approved following negotiations with the previous case officer and the Agent; that the resubmitted plans involved only minor amendments to the original design of the dwelling, which had been agreed with the previous case officer; that given the surrounding development and the fact that the site is outside of the Conservation Area it was considered that the proposal was, on balance, acceptable and that as previously advised there was no third party right of appeal and the decision cannot now be overturned. The Committee expressed its concerns that there was no right of appeal and it was RESOLVED that this matter be raised with Mary Creagh MP and with the YLCA.
1007 Relocation of Skate Park at Cross Lane The Clerk submitted correspondence from John Ritchie, Team Leader, Planning Services, Kirklees Council relating to the Council’s objection to the relocation of the skate park and advising that the application is deemed as permitted development and thus the need for planning permission is unnecessary. It was RESOLVED that the Clerk find out under which legislation this application is deemed permitted development.
1008 Planning Notifications and Planning Decisions Planning notifications and decisions were considered and observations made thereon.
