Plans Scrutiny Committee Meeting to be held on 29 September 2009

Agenda Item 7

At the August Plans Scrutiny meeting, members requested information about the decisions taken in relation to a number of planning applications. These are given below:

2009/61/91536
R Gledhill. Reserved matters applications for erection of detached dormer bungalow adjacent to 49 Gilthwaites Crescent, Denby Dale

Parish Council’s Recommendation: Council objected due to residential amenity which is impacted by the size of the proposed building..

Decision: Granted

Reasons:
The site comprises previously developed land. The development would have no detrimental affect on the visual amenities of the area nor any neighbouring properties and would not impact adversely on any highway safety issues.

Erection of extension and alterations to car park at Dearne Valley Health Centre Wakefield Road, Scissett,

Parish Council’s Recommendation: Object to this application, as Members have concerns re highway safety for disabled parking, poor access from/to extremely busy main road/junction. Space for disabled parking does not allow turning space, so vehicles have to exit in opposite gear to that entered and poses risk if reversing onto highway.

Decision: Granted

Reasons:
The application would not adversely affect the character of the Listed Building and there are no other material considerations which outweigh these findings

Erection of two storey side extension at 39 Pennine Rise, Scissett.

Parish Council’s Recommendation: No objection subject to visual and residential amenity

Decision: Refused

Reasons:
• In accordance with the guidance set out in Manual for Streets, parking spaces should measure a minimum of 3m x 6m. The parking space to be provided in the proposed garage only measures 2.7m x 5m which is considered to be inadequate. AS a result, vehicles would be unable to park in the garage increasing the likelihood of on street parking. This would be of detriment to the highway safety and contrary to Policies D2 and T10 in the Kirklees Unitary Development Plan.

• The proposed extension by virtue of its design and scale would be harmful to the visual character of the streetscene and represent an overbearing feature when viewed from the neighbouring property at 41 Pennine Rise. The proposal would thus be contrary to Unitary development Plan Policies BE1 (i & ii), BE2 (i) and BE14 and Planning Policy Statement 1.

Erection of dormer windows at 24 Stringer House Lane, Emley.

Parish Council’s Recommendation: No objection subject to compliance with green belt policies.

Decision: Refused

Reasons:
 The proposed extension cumulatively with the scale of previous extensions to the dwelling would result in disproportionate additions over and above the size of the original building. In such circumstances, the extension is inappropriate development in the Green Belt to the detriment of its open character contrary to UDP D11 and advice contained in PPG2 and PPS7.

 The proposed dormers would constitute an intrusive feature which is out of character with this traditionally designed farmhouse contrary to UDP BE1 (i)
